In 1975 the Allahabad High Court ruled that Indira Gandhi the then Prime Minister of India had won the Lok Sabha elections by fraud and banned her from politics for six years. Stayed for days even till then Indira Gandhi can continue as the Prime Minister of the country but the point here is that she will be the Prime Minister only till the next year ring of the Supreme Court whether she should stay next or not will be determined in the judgment of the Supreme Court but before this case goes for judgment again Indira Gandhi to change the laws against her is a terrible decision in the history of India. National Emergency means that in a democratic country the people but the opposition leaders do not have any rights. The basic rights of the people were asserted by the media and press. A few thousand people who spoke against the government were arrested and imprisoned. The years have darkened but what is the real National Emergency Indira Gandhi used Article 352 of the Indian Constitution as a weapon to escape from the judgment given by the Codes and protect her position. Where it started is that in 1971 Congress party won the parliamentary elections with a huge majority and Indira Gandhi became the Prime Minister of the country. Indira Gandhi contested and won as an MP but in the same constituency a person named Raj Narayana contested and lost as an opposition to Indira Gandhi but he accepted this defeat and lost.
Raju Narayana directly filed a case in the Allahabad High Court that Indira Gandhi had committed fraud in the elections and in that case he made a total of 14 elevations but the Allahabad High Court dismissed 12 of those 14 elevations and ruled that Indira Gandhi was really wrong in only two elevations like stage and loudspeakers
When Indira Gandhi campaigned in Raibareli Constituency she used Loudspeakers and Police Force of Uttar Pradesh Government for her election campaign which is a crime according to law and yespal kapoor a government gazetted officer working as Special Officer in Prime Minister Secretariat was recruited as her election agent. It means that the agent should campaign for him and work for him to win, but the problem here is that a government officer who is in service should not be recruited as an election agent and after this happened Indira Gandhi recruited him as her election agent on February 4th. Looking at all this even though he was an officer of her government the gave a speech in the election camp in January 1971. In 1975 Allahabad High Court canceled Indira Gandhi’s election in Rae Bareli for using a government missionary as well as using a government gazetted officer as her election agent. For years she was banned from any position without qualification and also the then Congress government was closed by the Allahabad High Court giving 20 days time to remove Indira Gandhi from the post of Prime Minister and elect another Prime Minister.
But after accepting this judgment Indira Gandhi challenged the High Court judgment in the Supreme Court but the Supreme Court also almost supported the High Court judgment but the change in the Supreme Court judgment is that Indira Gandhi did not immediately step down from the post of Prime Minister but the Supreme Court allowed her to continue till the next year. Let tell what happened outside. From the time of Indian independence in 1947 till 1975 the Congress party was ruling in India so anyway many opposition parties are looking for a good opportunity to defeat this party and come to power so even if they think this is the right opportunity all the opposition parties are also against Indira Gandhi Congress party. On one side rallies are being held and on the other hand Congress leaders are holding rallies supporting Indira Gandhi I do not know if Indira Gandhi will be the Prime Minister or not. In order to get out of this case Indira Gandhi wrote a letter to Pakriti Ali Ahmed who was the then President of India 21 June 1975 National emergency in India. Declared but here are some important things you need to know that is what is the actual national emergency who imposes it and how it is imposed. According to Article 3052 of the Indian Constitution written by Ambedkar the President of India declares a national emergency but this emergency should be imposed in these three situations. Number Two External Decoration means Emergency is declared when other countries attack India Number
Three Internal Disturbance means Emergency should be declared only when a disturbance is created to shake the country internally. Many things are imposed on the people on the opposition leaders on the press and media. In the time of emergency whichever party is in power in the state
the central government has to act as it says. Those who speak against the government are put in jail. In simple terms there is no democracy in the time of emergency. But till now only Indira Gandhi has declared National Emergency in India before 1975 Emergency was declared twice. But in order to know why the emergency imposed in 1975 is known as the dark days in Indian history we need to know the reasons for the emergencies imposed till then. After India’s independence in 1962 when India was at war with China emergency was declared based on the condition of external decoration in Article 350 Two. In 1971 when India was at war with Pakistan. Emergency was declared based on the condition of war but in these two conditions, emergency was declared to fight with foreign countries but why the emergency declared by Indira Gandhi in 1975 became so controversial is that she declared emergency based on the condition of Article 350. There is no Internet disruption in India to declare emergency but even now the President of India works on the advice of the Prime Minister and Cabinet so on June 25 on 1975 National Emergency was declared on the advice of Indira Gandhi.
But within 24 hours of the declaration of emergency every leader who spoke against the government was arrested and put in jail. Among them were national leaders like Morarji Desai Jayaprakash Narayana LK Advani and Charan Singh. The media and press offices that publish information without the public knowing what is happening in the society were cut off and not even a single newspaper was printed. Arrested because people do not gave fundamental rights during emergency time if they come on the roads like normal days during emergency time and want to express their opposition to the government they are directly arrested without any charges and taken inside the elections to be held in 1976 were postponed and many opposition leaders from national and regional parties came out and were afraid to speak against the government and remained in their homes until the next election.
It will be very difficult if the situation is such that this emergency was in force in India for about 81 months from 1975 to 1977. That is why these two years are described as the dark days of Indian democracy but what we need to talk about here is that during the time of emergency, some of the changes made by Gandhi in the Indian Constitution were made by Indira Gandhi in 1975. The 39th Constitutional Amendment was made to amend the Constitution especially the election of the Prime Minister making it free from any court in India to question it on those days
